Terms and Condition

New Accounts:

Every new account must be approved. Receiving a purchase order before it has been approved does not ensure that it will be accepted or fulfilled. Buyer must submit a completed credit application in order to apply for and create a credit account. At the discretion of our Finance Department, company financials, if available, may be requested or supplied in place of a credit application. When placing an order or submitting an application, all relevant sales tax exemption certificates must be submitted. Depending on their location, the buyer may choose to use different payment methods in order to prevent delays in processing their original transaction.

Costs and Estimates

All rates are subject to change at any time and will be offered on an individual basis. We reserve the right to cancel any quote at any moment until the buyer’s purchase order is received and accepted.

Terms of Payment

All invoices must be paid by the agreed-upon net terms from the invoice date, subject to credit approval. If a buyer doesn’t pay an invoice by the due date, the seller has the right to stop delivering to the buyer right away until the buyer has paid the entire amount owed.

Terms of Freight

Surface freight shall be used for all shipments from Seller’s warehouse locations to points, unless otherwise specified in writing. For such shipments, the seller may prepay the freight charges and add them to the charges shown on the invoice. The buyer undertakes to pay the seller back for the freight charges as shown on the invoice. Unless otherwise agreed in writing, the seller will choose the method, routing, and point of origin.

Delivery

Any verbal or written shipping dates given by the seller are estimates based on current inventory and the estimated time frames needed to deliver the requested items. It is the buyer’s responsibility to check the shipment when it is delivered. All acceptance forms must be signed by the buyer and the carrier in the event of short or obvious damage. Within five days of receiving the goods, the seller must be notified in writing of any shortages or signs of damage. Without sufficient notification, the products will be considered accepted with knowledge of any shortages or flaws that can be identified at the time of delivery, and the buyer will be considered to have waived all claims based on such deficiencies.

Taxes

The buyer bears full responsibility for all sales, use, and other taxes pertaining to goods acquired from Intech Devices LTD. If the buyer provides a tax exemption certificate that is accepted by the relevant taxation authorities, no taxes will be charged for shipments within the United States. If applicable, VAT will be levied to shipments made inside EMEA.

DISCLAIMER AND WARRANTY LIMITATION

The invoice or pricing quote will include the relevant warranty period. The products are sold “as is,” with all flaws included, if the relevant invoice or price quotation makes no mention of a guarantee period. Batteries are not covered under this guarantee.
Throughout the warranty period, we will either replace any damaged equipment, come up with a different solution to fit your needs, or fix the equipment if we can’t find a suitable substitute. We will credit your account with the purchase price if it is unable to accomplish either.

The return form’s instructions must be followed by the buyer. If equipment is found to perform to manufacturer’s specifications when returned, we will inform the customer of results of findings and charge appropriate handling or restocking fees.

Any failure of the equipment due to misuse, abuse, accidents, neglect or mishandling, improper maintenance, environmental factors, flooding, fire, or other natural disasters, physical damage, electrical problems like lightning, power surges, or incorrect electrical voltages, or improper modifications is not covered by the warranty. Any loss of profit, harm to a person or piece of property, harm to goodwill, special damages, costs, or other consequential losses or damages of any kind or nature, whether direct or indirect, are all beyond our liability and are specifically disclaimed by the buyer.
